What cookies are:
cookies are typically text strings that websites (so-called Publishers, or “first parties”) visited by the user, or different sites or web servers (so-called “third parties”), place and store – directly, in the case of publishers, and indirectly, i.e. through the latter, in the case of “third parties” – within a terminal device available to the user.

What cookies are used for:

Classification of cookies 
Cookies and, to a large extent, other tracking tools may have different characteristics from a temporal point of view and can therefore be considered on the basis of their duration (session or persistent), or from a subjective point of view (depending on whether the publisher acts autonomously or on behalf of the “third party”). However, the classification that reflects the rationale of the legal framework, and therefore also the need to protect the individual, is ultimately based on two macro-categories: - technical cookies, used solely for the purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide that service” (see art. 122, paragraph 1 of the Code); - profiling cookies, used to trace, back to specific, identified or identifiable individuals, specific actions or recurring behavioural patterns in the use of the functionalities offered (patterns), in order to group different profiles into homogeneous clusters of varying size, so that the controller can, among other things, tailor the provision of the service in an increasingly personalised way, beyond what is strictly necessary for the provision of the service, as well as send targeted advertising messages, i.e. in line with the preferences shown by the user while browsing online.

This is pursuant to the rule still applicable to this matter, namely art. 122 of the Code, according to which: “1. The storage of information in the terminal equipment of a subscriber or user, or access to information already stored, is permitted only on condition that the subscriber or user has given their consent after being informed in a simplified manner. This does not prohibit any technical storage of, or access to, information already stored if intended solely to carry out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide that service. For the purposes of determining the simplified methods referred to in the first sentence, the Garante shall also take into account proposals made by the most representative national associations of consumers and the economic categories involved, also with the aim of ensuring the use of methods that guarantee the effective awareness of the subscriber or user. 2. For the purposes of expressing the consent referred to in paragraph 1, specific configurations of software programs or devices that are easy and clear to use for the subscriber or user may be used. 2-bis. Except as provided for in paragraph 1, it is prohibited to use an electronic communications network to access information stored in the terminal equipment of a subscriber or user, to store information, or to monitor the user's operations”.
